Practice 02

Labor Law

Contested dismissal, unpaid compensation, workplace accident: the office assists employees and employers before the labor courts.

If you are an employee

The Labor Code (Law No. 65.99) gives you solid protection — provided you act in time and keep the right documents. Deadlines are short: if you have just been dismissed, do not delay.

Wrongful dismissal

A dismissal is wrongful not only if the reason is false, but also if the strict procedure has not been followed: prior hearing, written record, time limit and written notification. If any of these steps is missing, the dismissal is wrongful, whatever the alleged misconduct.

Documents you must keep

Your contract, payslips, dismissal letter with its envelope, warnings, and any written exchanges (emails, WhatsApp). Photograph or scan everything today.

Compensation and sums due

Depending on their situation, a dismissed employee may claim several cumulative indemnities:

  • Severance pay (based on length of service).
  • Payment in lieu of notice (if the notice period was not worked).
  • Damages for wrongful dismissal (up to 36 months maximum).
  • Untaken paid leave and salary arrears (overtime, bonuses).

Other disputes

  • Workplace accidents and occupational diseases.
  • Harassment (moral or sexual) and discrimination.
  • Forced resignation which may be requalified as wrongful dismissal.
  • Failure to register with the CNSS or under-declaration.

If you are an employer / HR manager

A properly conducted dismissal procedure costs a few hours of advice; a badly conducted one costs several months of salary in damages.

The office helps you secure your employment relationships and defends you in case of dispute:

  • Securing procedures: Drafting suspension letters, summonses to the prior hearing, and dismissal letters (disciplinary grounds, serious misconduct or economic grounds).
  • Contracts & regulations: Drafting employment contracts (fixed-term and permanent) with specific clauses (non-compete, confidentiality, mobility) and preparing the company's internal regulations.
  • Negotiated terminations: Negotiating and drafting settlement agreements (receipts for balance of account) to close a dispute without litigation risk.
  • Labor litigation: Defending the company before the labor court when a former employee brings a claim.
  • CNSS & inspection: Assistance during inspections by the Labor Inspectorate or the CNSS.

Frequently asked questions

Labor Law

Time limits in Moroccan labor law are short and vary with the nature of the claim. Some are counted in weeks from notification. This is why checking the deadline is always the first point examined in a consultation. Do not postpone your appointment to gather missing documents — come with what you have.
This is an offense, and it deprives you of significant rights: health cover, daily allowances, pension. You can request retroactive regularization of your situation and compensation for the harm suffered. The employment relationship can be proven by any means — payslips, transfers, certificates, badges, written exchanges.
A resignation must be free and unequivocal. If it was obtained under duress, threat or in a context of harassment, it may be requalified as wrongful dismissal, with all the resulting compensation. Proof relies on concrete elements: chronology, testimonies, written exchanges, circumstances of the signature.
Overtime gives the right to a statutory premium, higher at night, on public holidays and on the weekly rest day. The difficulty is proof: keep anything that establishes your actual working hours — time records, schedules, time-stamped emails, work messages, colleagues' testimonies.

Don't let the deadline run

Whether you need to contest a dismissal, claim sums due or secure a procedure as an employer, the first consultation immediately establishes what is still possible.
