Administrative Law

Challenging administrative decisions and defending the rights of citizens and businesses against the Moroccan public administration.

Any administrative decision — refusal of a permit, removal from a register, termination of a public contract — can be challenged before the Moroccan administrative courts. The office defends individuals, companies and associations against abuses or unlawful acts of the administration.

1. Action for annulment (abuse of power)

An action for abuse of power seeks the annulment of an unlawful administrative decision. It is subject to strict time limits (generally 60 days from notification or publication of the decision) and formal requirements.

  • Annulment of refusals (building permits, authorizations, approvals)
  • Annulment of disciplinary sanctions in the civil service
  • Challenging unilateral termination of administrative contracts
  • Actions against unlawful regulations

2. Full jurisdiction litigation

  • State liability: Compensation for harm caused by a fault of the administration (accident on a public road, medical error in a public hospital, etc.)
  • Public procurement: Contractual disputes, price revision, termination and compensation claims
  • Expropriation for public purposes: Challenging the amount of compensation

3. Urgent administrative interim relief

When an administrative decision causes serious and imminent harm, the administrative court may order the suspension of its enforcement by way of interim relief, pending a judgment on the merits. The office handles this essential emergency procedure.

4. Urban planning & building permits

  • Challenging refusals and withdrawals of building permits
  • Regularization of non-compliant constructions
  • Actions against demolition orders issued by the administration
