Frequently Asked Questions
Answers to the questions we are asked most often — about the firm, legal procedures, and your rights in Morocco.
The Firm & First Consultation

Yes, it constitutes formal legal work: analyzing your documents, qualifying the facts,
checking statute of limitations, and assessing your case's legal merits. The details are
communicated to you prior to the meeting, without any obligation to proceed further.
Yes. The firm holds remote video consultations for clients living outside Casablanca or
abroad. Documents are sent electronically beforehand. For court representation, a certified
power of attorney (mandate) is generally sufficient — your physical presence is not required
at every hearing.
In Arabic, French, and English. Procedural documents are drafted in Arabic, the official
language of Moroccan courts, but explanations, hearing reports, and written consultations
can be provided in your preferred language.
Absolutely. Attorney-client privilege is a matter of public policy in Morocco: it is general,
absolute, and unlimited in time. It covers your disclosures, documents, correspondence, and
the meeting itself. It also applies to consultations that do not lead to further actions.
Procedures & Timelines
There is no single answer. As a general guideline: a debt payment order (injonction de payer)
takes a few weeks; a divorce for discord (chiqaq) has a legal maximum of six months, and can be resolved well before then; a commercial
case on the merits in first instance often takes over a year; an appeal typically adds twelve to
eighteen months. The execution phase, which is often crucial and complex, must also be considered.
The statute of limitations (prescription) is the time limit after which you can no longer bring
a case to court, even if you are right. The limits vary strongly: very short in labor law, longer
in civil matters. This is the very first check performed by the firm. When in doubt,
consult: an expired deadline can never be recovered.
Often, yes — and it is frequently preferable. An attorney demand letter is often enough to
resolve a situation. When it is not, negotiating a settlement protocol, mediation, or
arbitration can yield faster, final results without appeals. The firm systematically explores
these pathways before filing.
A court judgment is not cash: it must then be enforced. The firm initiates enforcement actions
— bank account garnishments, property seizures, salary attachments — via a bailiff. This is
why the opponent's solvency is checked from the start: filing a case against
an insolvent debtor is rarely a good investment, and the firm will tell you so.
Representation by an attorney is mandatory before most Moroccan courts, especially in appeal
and cassation. It is not mandatory everywhere — but representing yourself against an opponent
assisted by counsel means, in practice, giving up a significant part of your chances.
Questions by Practice Area
Act quickly: the time limits for contesting dismissal are among the shortest in Moroccan law.
The Labor Code imposes a strict procedure on the employer (prior hearing, written reasons,
notification). Failure to comply makes the dismissal wrongful, opening rights to compensation.
Keep your dismissal letter, payslips, and contract.

It depends on the nature of your proof. If the debt is certain, liquid, due, and based on an
instrument (acknowledgment of debt, bill of exchange, bounced check), a payment order (injonction de
payer) is the fastest way. When the debt is disputed,
proceedings on the merits are required.

The Moudawana provides several paths. If both spouses agree, divorce by mutual consent is by far
the fastest and least expensive. Without agreement, divorce for discord (chiqaq)
can be requested by either spouse without proving a fault — this is now the most common route.
There are also specific tatliq procedures, khol', and revocable divorce.

Call a lawyer without delay. The person in custody has the right to be assisted and communicate
with an attorney, within the terms and timeframes set by the Code of Criminal Procedure. The first
hours are critical: statements made at this stage will remain in the file for the trial.

Before any payment, have the legal status of the property verified. Is it registered (title deed)
or unregistered (melkia)? A recent property certificate must be obtained from the Land Registry
to reveal mortgages, attachments, or caveats. Also verify the seller's capacity, co-heirs'
rights, and urban compliance.

This is a common situation, handled entirely remotely. The stages are: establishing the deed
of inheritance, inventorying the assets, obtaining property certificates, and then amicable
or judicial division. A legalized power of attorney from the Moroccan consulate in your country
allows the firm to handle all steps without your presence.
Costs & Legal Aid
legal aid (assistance judiciaire) exists in Morocco: it allows low-income citizens to be defended
free of charge, upon decision of the court's legal aid office. The firm will indicate if you are
eligible and help compile the file. A structured payment plan is also always possible.
Raise this in the first meeting.
Court costs (dépens) are generally charged to the losing party. However, in Moroccan practice,
the compensation awarded for attorney fees remains moderate and does not necessarily cover all
your fees. This point will be explained and quantified before filing.
Yes, at any time and without justification. Free choice of a lawyer is a fundamental right.
You remain responsible for fees corresponding to work already completed. The firm will transfer
the complete file to the succeeding colleague so no information or deadline is lost.
Important Reminder
These answers do not replace a consultation
The information on this page is general. Two situations that look alike can call for opposite legal answers depending on a date, a clause, or a document. Only a detailed review of your case can answer you with certainty.
